1 National Law School of India University, Bangalore RCC RULES MPP Class of 2016 Chapter I: Title and Definitions 1. Short Title and Application: (a) These rules will be called The Rules regarding the Functioning, Governance and Management of the Recruitment Coordination Committee and the Recruitment Coordination Committee Class, MPP Class of 2016 at the National Law School of India University. (b) For convenience, these rules will be referred to as RCC Rules. (c) RCC Rules will apply to the Recruitment Coordination Committee Members, as well as to all members of the constituted Recruitment Coordination Committee Class. 2. Commencement of Rules: These rules will not have retrospective effect. These rules will come into effect upon ratification by RCC Class by simple majority of members present and voting. 3. Definitions: In these rules, unless the context otherwise requires: (a) Applicant means an MPP participant of the Class of 2016, National Law School of India University, who has become a member of the RCC Class. (b) CGPA means Cumulative Grade Point Average of the member of the RCC Class as calculated by the Exam Department. Explanation I: In case of any patent error in the calculation of the CGPA, any two members of RCC, in the presence of the concerned RCC Class member, shall be authorized to verify and correct the CGPA. Once such a change is made, it shall be notified to the RCC by the two vetting RCC members in the form of an to the RCC ID and shall be made to reflect upon the rank list. Explanation II: The CGPA shall be calculated on the basis of the provisional transcript and the trimester-record upto the last trimester for which results have been declared. (c) RCC means the five member Recruitment Coordination Committee which has been duly elected on 07 August 2015, by the MPP Class of 2016, National Law School of India University; and any other member(s) thereinafter elected due to vacancy. 1

2 (d) Content means entry in the CV related to any curricular, co-curricular or extracurricular achievement(s) or activity participated in, or positions of responsibility held by, the applicant. (e) Document also includes any electronic document. (f) Employer includes any organization that may recruit or provide internships or provide Pre-Placement Offers (g) Master CV means the comprehensive resume submitted to the Committee at a stipulated date which shall contain all achievements, internships, CGPA etc. of the member till that particular date. All amendments or additions submitted at any time after the stipulated date shall also be considered to be part of the Master CV. All copies of the Master CV and any amendments or alterations to the same must be duly vetted prior to submission of the same to the Committee as per the Vetting Rules. (h) "Meeting" means physical gathering or gathering as per the RCC Phone and Internet Rules. (i) "Observer" means a member of RCC 2017 selected by RCC 2016 (j) "Online Voting" means voting as per the RCC Phone and Internet Rules. (k) Pre-Placement Offer means an offer of employment made by any RCC Firm to any member of the RCC Class prior to the commencement of the Recruitment Period. (l) Proxy voting means the casting of one s vote through a person authorized by way of signature when one is absent during the conduct of that voting (m) RCC Class means all the members of the MPP Class of 2016 who have subscribed to RCC by payment of the stipulated fees. (n) RCC Firm means an employer notified by the RCC (o) Recruitment Period means the time period in which all RCC Firms will interview and assess all applicants, and decide upon their choice of candidates, as per the schedule decided by the Committee. (p) Submission means the submission of the Curriculum Vitae (hereinafter CV) to the RCC, as and when requested for. (q) Vetting means verification of the contents in the CV of an applicant by the RCC according to the vetting rules. Chapter II: General Rules of Conduct 2

3 4. Attendance in Committee Meetings: All meetings shall be attended by the members of the Committee only. If any member fails to attend a meeting, such person shall give valid reasons for the same at the next meeting. The failure to attend three consecutive meetings shall entail action against such member as explained in Rule Minutes of meetings: (i) RCC shall maintain minutes of all meetings, and the minutes shall be first circulated within the RCC for vetting by RCC members. (ii) RCC shall periodically mail minutes of the meeting to the RCC class every month. Urgent communications may be made to the class in accordance with the decision at the RCC meeting. (iii) In cases of specific queries in relation to discussion at prior RCC meetings, responses shall be sent within 48 hours along with attached minutes of the relevant meeting. 6. Accountability: Any individual member of the RCC will not be allowed to approach any employer independently for the purpose of proposing its inclusion as an RCC firm, without the consent of the majority of the members of the RCC. 7. Confidentiality: All members of the Committee and Observers from RCC 2017, NLSIU, are bound to maintain confidentiality as regards any information received in exercise of their duties. This clause will not be invoked in cases where transparency is required. In case of conflict in matters of transparency, the matter will be decided by the faculty advisors based on a written appeal by at least 1/10 th of the members of the RCC class. 8. Goodwill Principle : At any point in time if an RCC Class member is approached with an opportunity which may extend to one or more individuals of the RCC Class they shall be expected to disclose it to the RCC. 9. Maintenance of Accounts: (i) All accounts related to the Recruitment Coordination Committee and its functioning shall be maintained by a member designated by the committee. (ii) All expenditure incurred by the Committee per se, or by any other person on behalf of the Committee, shall be brought to the notice of the Committee and ratified prior to any reimbursement for the same. 10. Quorum for Committee Meetings: At least 3 members shall be present for the conduct of a valid meeting. 3

4 11. Decisions within the Committee: (i) All decisions within the Committee shall be made by the assent of at least 3 members present. (ii) In case there are absentee members for a committee meeting in which decisions are taken, absentees in case of dissenting views with the decisions made at the above mentioned RCC meeting shall be required to provide their reasons for dissent by way of within 24 hours of the internal circulation of minutes of the meeting. A meeting shall be reconvened for the purposes of discussing the contentious issue, and a revote shall be taken on the issue. 12. Notice of RCC Class Meeting: 24 hours notice shall be given for all RCC Class meetings by to the class group. If possible an announcement regarding the same shall also be made during a compulsory class. A notice given as above would be sufficient notice for a Class meeting. Provided, that in the case of emergencies, as decided by the RCC, any shorter time period of notice will suffice. 13. Quorum for RCC Class Meetings: The quorum for the RCC Class Meeting shall be one-third (1/3rd) of the RCC Class. 14. Communication: All communication between Committee members and any member of the RCC Class as regards any matter within the purview of the RCC shall be in writing (including ) and the Committee shall maintain a copy of the same. No communication via SMS or any kind of instant messaging/ online chat shall be considered a valid communication. 15. Complaints: Any complaint against RCC per se, or any RCC member(s), shall be taken into cognizance only upon the receipt of a written complaint duly signed by the complainant and submitted via to the RCC ID, and also copied to the class group. All such complaints shall duly specify the charges. 16. Decisions of the RCC Class: All decisions at RCC Class Meetings are to be taken by a simple majority of the total members present, through personal voting or proxy voting. Explanation 1: Those members of the RCC Class who exercise the option of proxy voting shall be included in calculating the number of members present for determining the majority for the purposes of this rule. Explanation 2: In case of a tie, the RCC committee as a whole shall have the casting vote as determined by a simple majority within the RCC members. 4

5 17. Finality of decisions: Once decisions have been taken by a majority of votes as per the above-mentioned rule, those decisions can be re-opened within a period of ten days from the date of the original decision if a written request is given to the Committee, seconded by a number which is more than the number of people of RCC class who voted in favour of that decision, attested by way of signatures. If the decision is made online, a mail sent from the individual's official college id, will suffice. 18. Suo Motu Reopening by RCC: Once decisions have been taken by a majority of votes as per the above mentioned rules, those decisions may be re-opened at any time if a majority of the RCC so votes and exceptional circumstances so require. Explanation: Circumstances may be deemed exceptional only if, in the opinion of a majority of the RCC members, it affects a majority of the RCC Class. 19. Removal of Committee Members (i) Removal initiated by Committee: Where any Committee member is of the opinion that any other member(s) of the Committee has engaged in any conduct unbecoming of a Recruitment Coordination Committee member, the same shall be brought up before the Committee and if the Committee, by simple majority, is of the opinion that the accused member has indulged in activities unbecoming of an RCC member, it shall make its recommendation and lay down the same before the RCC Class; whereupon the RCC Class and RCC members, by simple majority of members present and voting, can remove the said Committee member. Explanation 1: The member(s) against whom the action is being brought about cannot vote upon the said issue. However, the member in question should be given an opportunity to explain him/herself at both the RCC and the Class meetings. Explanation 2: All members of the Committee shall be present for removal proceedings. Explanation 3: Explanation of unbecoming conduct will be in accordance with internal functioning memo to be circulated within a week of the ratification of these rules. (ii) Removal initiated by Class: To initiate removal procedure against an RCC member, the complainant has to submit a written petition via with the support of one-third of the RCC Class; attestation by way of signatures will be sufficient for this purpose. The RCC member against whom the action is contemplated should be given an opportunity to explain him/herself at the Class meeting. After expiry of 24 hours period, an RCC class meeting shall be held and a vote shall be taken on the matter. The RCC Class and RCC members, by two thirds majority of members present and voting, can remove the said Committee member. 5

6 Explanation : The member(s) against whom the action is being brought about cannot vote upon the said issue. However, the member in question should be given an opportunity to explain him/herself at both the RCC and the Class meetings. 20. Vacancy: In case of vacancy of membership of the Committee, due to any reason (including resignation), fresh elections shall be held by the RCC Class to fill the same within seven working days of the vacancy. 21. Leaving and Rejoining RCC Class: Prior to resigning from RCC Class, the member shall give notice of one week to the Committee. If the member wishes to leave in the aftermath of a meeting wherein the RCC rules have been amended, he or she must do so within 48 hours of that meeting. After resigning from RCC Class, an RCC Class member shall not be allowed to re-join RCC Class for a period of four weeks, if he/she has voluntarily resigned. Exception: In the case of extenuating circumstances, or where the individual has been disqualified under the one job rule, he/she will be allowed to re-join within the four weeks with the majority approval of the RCC. Chapter III: Internships 22. Committee Authorization: Applications to RCC Firm for internship are open to the RCC Class. In the event an employer wants to select interns through the RCC process, the Committee shall have the authority to handle the applications. Explanation - authority to handle shall include the authority to reject applications that are not in material conformity with the vetted Master CV and are not suitably amended within the time provided by RCC. 23. RCC Firm List: The Committee shall announce a provisional list of RCC Firms; subsequently the members of the RCC Class cannot approach the specified RCC Firm independently outside RCC for any purpose pertaining to employment or internship. Explanation 1: The above mentioned list is subject to amendment by the Committee from time to time. The provisional list pertaining to each internship period shall be disclosed to the RCC Class at least 15 days before that particular internship period. 24. Holding Rule: (i) Once a member of the RCC Class is selected for an internship by a particular employer through RCC, he/she shall be barred from applying to other RCC Firms which may open up for internship applications in the future through the RCC for the same time period. However, 6

7 under exceptional circumstances, the RCC may allow a member of the RCC class to apply to other RCC firms for the same time period. Illustration - A has applied for X offices in Bombay, Delhi, Bangalore in that order, through RCC. A successfully secures an internship at AZB Bangalore. A accepts the internship and a confirmation of acceptance is sent to AZB Bangalore. Later, applications for PQR open up, one week after A has confirmed for AZB. PQR is also coming through RCC for the same period. In this case, A will be barred from applying to PQR. Explanation 1: For the removal of doubts, it is clarified that call back offers are subject to the holding rule. Call back offers are offers made by firms/organisations where a participant has previously interned, for the next internship period. However, all call back offers offered prior to the approval of these rules by the RCC Class shall have to be accepted or rejected before the conclusion of the first application period that RCC specifies. RCC Class members who have received or receive call back offers shall be required to inform the same to RCC through an to the RCC ID within one week of receipt of the same. Explanation 2: For the removal of doubts, it is hereby clarified that this rule shall apply to internships secured to an RCC Firm independently through an application made prior to the approval of these Rules by the RCC Class. (ii) No member of the RCC class shall be allowed to take part in the recruitment process once (s)he has been selected by an RCC firm. However, RCC Rules shall continue to apply to such a person. 25. Mode of acceptance/rejection: (i) The acceptance of internship offer to any RCC Firm has to be conveyed to RCC at rcc.mpp14@nls.ac.in within 48 hours from the time the list of people chosen for internships to that RCC Firm is posted on the RCC class group and sent to the applicants on their personal address as notified by them to the Committee lest an applicant is awaiting such a result from more than one firm, the period of 48 hours shall be counted from the time of the declaration of the latest offer made to the applicant or as may be prescribed in advance by the RCC firm making the first offer whichever is shorter. At the end of 48 hours, if no acceptance/rejection of offer is conveyed to RCC class of 2016 it will be considered as deemed rejection of the offer and the same shall be conveyed to the RCC Firm. However, if at the end of the first 24 hours, there is no communication through , it shall be the duty of the RCC to inform the applicant of an impending deemed rejection before the expiry of the said period through . Any acceptance/rejection, as the case may be, shall be intimated by the RCC on the RCC Class Group. 26. Rule on Deferrals: Any deferral of place (RCC Firm), period and/or city shall not be permitted. Provided that, owing to extenuating circumstances, the Committee has the discretion to permit applications for deferrals. 7

8 27. Preference of Cities: Once a particular preference is given at the time of application, it cannot be changed at any later stage, if it is prejudicial to any other member of RCC Class. Equal preference/no preference would mean that that person would take the offer which is made first. Offer in this case includes waitlist/interview requirements. Explanation: What constitutes prejudice shall be determined by RCC based on objections raised by any member of the RCC class. An objection may be raised by sending an from the individual's official college id to rcc.mpp14@nls.ac.in.provided that this rule will not be applicable in cases where the change in preference has been initiated by the RCC Firm. 28. Submission of Curriculum Vitae: All members of the RCC Class shall submit their Master CV to the RCC, within 5 days of the relevant format being circulated, through the official RCC ID.. Submissions of CV for application to specific employers, as and when required, shall be subject to review by the Committee. All entries in CV thus submitted must correspond with the vetted and reviewed entries in the Master CV. Failure to submit the vetted CV by the specified deadline would lead to disentitlement of the candidate from applying. The candidate must get his/her CV certified by the Committee members who shall specify the timings for the process. 29. Verification of Applications Sent: An applicant who wishes to verify the contents of his/her application to an RCC Firm may approach an RCC member and upon such request, the RCC member shall show the forwarding along with the applicant s Curriculum Vitae sent therein. 30. An applicant who accepts the internship must report at the concerned office for the stipulated duration of the internship and fulfil the other requirements of the internship. 31. An applicant who fails to comply with the requirement in section 30 shall be barred from sitting for the recruitment process facilitated by the RCC and is removed from the RCC Class of 2016 after due hearing with effect from the date of non compliance to the rule. Chapter IV: Recruitment 32. One job Rule: 1. If any member of the RCC Class gets a standing offer and/or pre-placement offer from any RCC Firm, he/she will have until the commencement of the recruitment period to either accept or reject the said offer. 8

9 2. Notwithstanding anything contained in these Rules, it shall be the duty of every member of the RCC Class to inform the RCC as soon as that member gets a standing offer and/or pre placement offer from any RCC Firm. 3. Notwithstanding the fact that a longer period of time has been allowed by the RCC Firm for acceptance/rejection of the standing offer, including the possibility of a deferral, subsections (1) and (2) will be applicable in the case of all standing offers. 4. Notwithstanding anything contained in the above said sub-sections, the obligation of any member of RCC Class to pay off all the dues to the RCC till that day shall not be affected and he/she shall have to pay the said dues. 5. This Rule shall have retrospective effect. Explanation: Rejection must be communicated simultaneously to the RCC Firm and RCC on rcc.mpp14@nls.ac.in within the prescribed period. Acceptance needs to be conveyed only to RCC within the prescribed period. 6. No member of the RCC class shall be allowed to take part in the recruitment process once (s)he has been selected by an RCC firm. However, RCC Rules shall continue to apply to such a person. 33. Show Cause Procedure: (a) A show cause hearing shall be initiated against any member of the RCC Class for alleged violation of the RCC Rules by the RCC. The RCC shall be the adjudicatory authority, and shall conduct the proceedings of the show cause hearing fairly, and shall allow the accused to present his/her case before the RCC. All members of the RCC must be present for any show cause proceedings. Provided, that any accused party, if also a member of the Committee, shall not be entitled to participate in the hearing as a Committee member, and therefore shall not be entitled to vote upon the matter. (b) Such a proceeding shall be initiated by serving a notice within 48 hours on the accused person(s). Such a notice shall specify the charges against the accused person(s). Such person(s) shall reply to the charges within 24 hours of the notice being served. (c) An intimation of the initiation of the show cause proceedings shall be posted on the class group. Such intimation shall not specify the charges against the accused person(s). The result of the show-cause proceeding will be posted on the class group. (d) RCC meeting rules of procedure shall apply, to the extent possible, to the show-cause proceedings, subject to the exception of the quorum rule. (e) RCC Class shall be the Appellate body for all show cause proceedings hereunder, and the accused can prefer an appeal. 9

10 (f) Decision making at show cause proceedings shall be by special majority (two thirds) of members present and voting. (g) An accused may choose to waive confidentiality of the show cause proceedings. 34. Fines and other Actions: (1) In the event a member of the RCC Class is, after a formal show cause hearing conducted by the RCC, found to be in violation of any of the RCC Rules, the Committee may impose a fine subject to a maximum of Rs. 10,000 and/or expel the concerned member from the RCC Class. If the concerned subscriber to RCC fails to pay up within the time period stipulated by the RCC, the RCC shall reserve the right to withhold that person s CV for the purpose of all subsequent RCC processes. The RCC will disregard any internship secured through such subverting processes and the same internship will be deleted from the Master CV of the concerned RCC subscriber for the purpose of all further RCC processes. Explanation: Expulsion of any member from the RCC Class shall require a simple majority of the regularly convened RCC Class meeting. (2) Without prejudice to the generality of the previous sub-section, in case an applicant is found guilty of material misrepresentation in his/her CV sent to an RCC Firm, the RCC may intimate the firm of such misrepresentation. Provided, that such applicant aggrieved of the decision taken by the RCC may, within 72 hours, refer the matter to the RCC Class which by a secret ballot may overturn such decision of the RCC on a simple majority. Chapter V: Miscellaneous 35. Admission to RCC Class: Any participant of the MPP Class of 2016 is entitled to become a member of the RCC Class subject to the following conditions: (a) Payment of all dues till the specified date. (b) The prospective member should not hold a job and/or a standing offer and/or a preplacement offer and/or a training contract at an RCC Firm at the time of joining the RCC Class. 36. Fees Payable by Members: The total fees payable towards the Recruitment Process by each member of the RCC Class is Rs.500. Once the fee is paid, the details of payment will be notified to the class within 48 hours. RCC will require additional fees to be paid, as and when required. All details of expenditure will be notified to the class at the end of every month. 37. (i) The specified time period and quantum regarding the payment of the fees shall be notified by the RCC. 10

11 (ii) Any quantum of fees once paid under this rule will not be refundable under any circumstance. 38. Any contravention of any of the rules contained herein shall attract proceedings under Rule Code of Conduct at Pre Placement Talks: (i) Pre Placement Talks (hereinafter PPT), are those presentations made by the potential Employer to the RCC Class as a whole for the purposes of introducing the particular firm/organisation etc., and have been declared to be PPTs by the RCC for the purposes of this rule. (ii) All RCC Class members are required to attend all PPTs which are organized by the Committee. Attendance at PPTs is compulsory for all members of the RCC Class except where a member is unable to attend due to extenuating circumstances. Attendance shall be taken at all PPTs. Explanation: What constitutes an extenuating circumstance shall be determined by the RCC on a case by case basis. (iii) All RCC Class members and all those attending a PPT are required to maintain a dignified and orderly conduct at all PPTs, and in no way cause any embarrassment to NLSIU or to the Class. Explanation: (a) Walking out of the PPT once inside; (b) Walking in late; (c) Reading of Newspapers or any other material; (d) Sending SMSs, or talking on the mobile phone, or the use of computers once inside etc. would constitute violation of this sub-rule. However, this list is only illustrative, and the Committee shall in its discretion deem any other inappropriate conduct to be in violation of this sub-rule. (iv) Any violation of the above rules will result in strict disciplinary action instituted against such member or person attending the PPT under Rule All future correspondence regarding any matter relating to Recruitment Coordination Committee shall not be with individual RCC members but through mail sent to the RCC e- mail account. 11
