1 Council s Round Table June 2014 To see minutes in detail please click here Volume 1, Issue 1 Special points of interest: No State assistance to relocate Boyanup Saleyards St John Ambulance sub centre to co locate with the Bushfire Brigade Boyanup DSR provides Bunbury Wellington District Sports Facilities Plan 2013 for Council consideration Inside this issue: Boyanup Saleyards 2 Overnight Stay Caravan Site A report was prepared for Council to consider potential opportunities and issues for Overnight Stay caravan sites within Capel town. The report considered a number of sites that were within close proximity to the town centre, however it was felt that with the proposed establishment of the waste dump site and parking for several caravans in stage 1 of the Capel Civic Precinct (2015/16)development and the re development and re opening of the Peppermint Grove Beach Caravan Park, it was suggested that Council not undertake the development of an Overnight Stay caravan site in the Capel townsite, but are prepared to consider the establishment of a temporary roadside rest area for visitors to Capel who wish to stay in the area over night or if longer to be directed to the caravan park in Peppermint Grove Beach. Council agreed to the suggestions and directed the CEO to consider in more detail the site suitability and feasibility of providing a temporary road side rest area on Berkshire St (adjacent to the Capel Recreation Ground) specifically for self contained vehicles for stays no longer than 24 hours, and to investigate the requirements of establishing Ironstone Gully Falls as a nature based camping area. St John Ambulance Boyanup 2 Sale of Land & Buildings - Lot 10 Thomas St Boyanup Dalyellup POS Tender Elected Member Allowances Cleaning Tender Awarded Extractive Industry Gelorup 2 3 The Finance Story 3 Amendment to TPS #3 Sub division Plan Modifications Bunbury Wellington Districts Sport Facilities Short Bites Extra Cats Denied Council resolved to advertise for 14 days its intention to sell lot 10 Thomas Street Boyanup including the existing three units, to Access Housing Australia Limited to allow for the development of seniors housing units for Boyanup residents. The proposal from Access Housing is to develop the new homes, then move the existing tenants into the new homes and refurbish the existing dwellings. It is expected that the units constructed will achieve a minimum 5 star energy rating and be of a low maintenance nature. The development of the housing units will provide the opportunity for a number of seniors to be located in one complex leading to improved social interaction between seniors. This action meets the following objectives of the Shire of Capel Strategic community Plan Strategic Direction 4 action 4.4 Improve the attraction of the towns as a retirement destination. Shire of Capel Corporate Business Plan Strategy 4.4A Plan for a variety of residential accommodation options, facilities and services for seniors and Action 4.4A2 Plan for and promote Boyanup as a retirement destination as part of the growth of the town. It also meets a variety of objectives in the Boyanup Townsite strategy as well as the Shire s Age Friendly Report. Access Housing Development in Capel

2 Council s Round Table Page 2 Relocation of Boyanup Sale Yards Council received advice from the WA Beef Council indicating that it does not support further spending on South West Saleyards and that any future new saleyards is the responsibility of the Shire of Capel and WA Livestock Salesmen s Association. The establishment of strategically located saleyards in this state has been previously identified in the State Saleyards Strategy and is clearly State strategic infrastructure that will benefit whole of industry with exports interstate and overseas and should be substantially, if not fully funded by the State Government as it has done with the others in this State. It is believed that the current position of the State Government not to provide substantial funding is, in Council s view not related to the need or justification or industry or commercial interest but the lack of funding at it s disposal. This Council supports a fully costed facility that is available to all industry participants, but the only way that this will happen is if the State Government comes to the party and provides substantial funding towards the land purchase and saleyard construction costs for new saleyards in the South West, otherwise the industry risks losing a saleyard in the South West if Council makes the decision not to renew the lease in 2022 resulting in the current saleyards closing. St John Ambulance Sub Centre to Co-locate with Bushfire Brigade The purpose of the reserve should not be restricted to accommodate only Fire Brigade Council considered a request from St John Ambulance to co locate with the Bushfire Brigade on Reserve R2629 Lot 42 Turner Street Boyanup. The proposal allows for the development of a 2 vehicle bay garage, staff meeting rooms and toilets and a 5 bay car park. Shire staff believed that in addition to St John Ambulance, there may be need for other emergency and / or community services to locate on the reserve and therefore the purpose of the reserve should not be restricted to accommodate only Fire and Ambulance services. Council resolved to support the proposal for St John Ambulance to colocate with the Bushfire Brigade on a portion of Reserve R2629 Lot 42 Turner Street and; To authorize the Chief Executive Officer to obtain the relevant approval from the Department of Lands to change the purpose of the reserve to accommodate Emergency and Community Services; and also obtain power to enter into Lease Agreements. Dalyellup Public Open Space (POS) Maintenance Tender Dalyellup Lakes The Shire is in the final stages of handover of additional POS and streetscape landscaping within the Dalyellup Estate from property developer Satterley Property Group. The handover areas includes the Northern and Middle Lakes as well as a number of streetscapes and POS. As such Council called for Tenders to undertake the proposed works with the proviso for Council to split the tender into portions to provide best value. Council accepted the tender offer of Dirt Designs and LD Total for the Dalyellup Public Open Space Landscape Maintenance contract.

3 Volume 1, Issue 1 Page 3 Elected Members Allowances 2014/15 Budget Fees and allowances are payable to elected members in accordance with the Local Government Act 1995 and are either entitlements or discretionary. These include meeting attendance fees, telecommunications allowance and information technology allowance. Council agreed to not accept an increase in the 14/15 budget. Cleaning of Shire Building and Public Amenities Tender 14/03 Council considered the adoption of the tender submission for the Cleaning of the Shire of Capel Buildings and Public Amenities. Council accepted the tender from Delron Cleaning Bunbury for the provision of cleaning services for Shire Buildings and Publc Amentities as detailed in Tender 14/03. The contract will be for an initial period of 2 years from 1 July 2014 to 30 June 2016 with an option to extension for a further 1 year period. Shire President Cr Murray Scott Extractive Industry Lots 3 & 27 Allenville Rd Gelorup Council considered the renewal of Planning Consent and an Extractive Industries License by Hanson Construction Materials Pty Ltd to continue to extract basalt from Lots 3 & 27 Allenville Rd Gelorup. Hanson Construction Materials Pty Ltd has extracted basalt from the Gelorup Quarry since the mid 1970s and asked Council for a 20 year planning approval. Council resolved to grant Planning consent subject to the development being limited to what has been in the approved Gelorup Quarry Excavation and Rehabilitation Management Plan dated October 2013; Approval being limited to 18 June 2024 ( a ten year planning approval) and entering into an agreement regarding the maintenance of Lillydale Road for the life of the extractive industry; Council also agreed to the issue of an Extractive Industry Licence pursuant to the Shire s Extractive Industry Local Laws; That officers advise the applicant that it is Council s expectation that there will be ongoing consideration given to the Closure and Rehabilitation Program for the site. The applicant s proposal for a 20 year approval is inappropriate and unnecessary and will not provide Council with adequate ability to review the current undesirable scenario of a hard rock quarry within the recommended buffer distance to an urban area. The Finance Story Council resolved to adopt the updated Shire of Capel ten year Long Term Financial Plan , including the revised timeframes and budget funding allocations for the various services strategies and plans referenced in the Plan. Council approved the draft Capital Works Program and draft Budget for 2014/15 as presented. Council also authorised the Schedule of Accounts for payment and adopted the financial statements for the period ending 31st May Council will adopt the final 2014/15 budget at July s Ordinary Meeting.

4 Council s Round Page 4 Development has the potential to provide the start of the dual path link from Loretta Ave to Norton Promenade traffic lights Town Planning Scheme Amendment - Gelorup Town Planning Scheme Amendment Corner of Loretta Avenue and Bussell Highway Gelorup In March 2011 the Minister for Planning approved new zoning and development standards to enable the future expansion of the Condellos liquor store and the development of a convenience store on several parcels of land located at the corner of Loretta Avenue and Bussell Highway. A convenience store is a premise that can sell goods commonly found in supermarkets, delicatessens and newsagents as well as the sale of petrol. The land owners have found that they need to change the zoning standards to allow the convenience store to be built before the expansion of the liquor store. There is also a need to increase the floor size limits on the existing takeaway food premises and the proposed convenience store. The proposed changes were advertised for public comment during February and eight submissions were received from a combination of government agencies and nearby landowners. Council gave consideration to the submissions and acknowledged that the proposed changes were not significantly different to the original scheme approval of the Minister and all issues raised can be adequately addressed during the development phase of this proposal. The proposal has however been improved by the Main Roads Department now requiring the land owners to give up land for a slip lane off the highway onto Loretta Avenue. The eventual development will also provide the start of the dual path link from Loretta Avenue to the Norton Promenade traffic lights. Council has supported the minor changes to the zoning of the land and will now forward it to the Minister for consideration. Modification to Subdivision Guide Plan - Gelorup Special Rural Zone In September 2013 Council refused to support a modification to the Guide Plan for the Gelorup Special Rural Zone as the land owners could not demonstrate that the subdivision of their lot could comply with the requirements of the Main Roads Department for future highway widening and also result in providing two lots which have satisfactory amenity and fire safety for future residents of the lots. The land owners appealed to the State Administrative Tribunal (SAT) and after considerable time have produced a subdivision proposal that demonstrates compliance with requirements. The landowners raised concern over the Main Roads Department wanting a portion of their land to be given up free of cost at the time of subdivision. The Council has now resolved to defer making a decision on the matter pending the landowners having future discussion with Main Roads WA in respect to the particular portion of land required.

5 Volume 1, Issue 1 Page 5 Bunbury Wellington District Sports Facilities Plan 2013 Stage 2 Council received the Bunbury Wellington District Sports Facilities Plan Stage 2 from the South West Department of Sport and Recreation, and resolved to acknowledge the report as a guiding and reference document to assist future recreation planning and the development of sports facilities in the Shire and within the region. The study area comprised the Shires of Capel, Dardanup, Collie, Donnybrook Ballingup and the City of Bunbury. It takes into account current industry trends, demographic projects, current planning processes, selected consultation with local government, state government and other nominated stakeholders and an assessment of each sport s anticipated needs. Key recommendations coming out of the plan include : The need to establish a coordinated across LGA boundary process for the development of infrastructure to ensure that facilities are not duplicated and to assist in negotiating funds; A long term strategic plan is required for Equine Provision Dual use of recreation spaces with the Education Department; Water / Climate / Environmental considerations Cost & Access to Facilities. Council approves the CEO s leave for the period 13 April to 15 May 2015 and appoints the Director Corporate services as Acting CEO Council advises the Western Australian Local Government Association (WALGA) that it has no objections to WALGA entering into a fixed term, fixed interest rate debt arrangement to finance the remaining debt under pinning the new building at 170Railway Parade West Leederville Perth Application to keep 6 Cats - Boyanup Council was asked to approve the keeping of six cats on a property in Boyanup. Council s Local Laws relating to cats requires a person wishing to keep more than two cats on a property to apply for an approved permit, and also requires that the cats be confined to the property at all times. Based on the number of objections received and the number of cats involved, Council did not grant the exemption.

The Plan outlines the long term (10+ years) vision, values, aspirations and priorities for the Shire of Capel. It is not a static plan and will be reviewed regularly. It takes into consideration other Shire strategic and operational plans, information and resourcing capabilities, and will ultimately be a driver for all other planning within the Shire. The Shire s corporate business plan links to the strategic community plan and is a four year plan which outlines in detail the projects, services, operations and performance measurements required to deliver on the priorities identified in the strategic community plan. Annual reviews will drive the operations of the Council within its resourcing capabilities. We re on the Web Council Meetings & Public Question Time Ordinary Council meetings are held on the third Wednesday of every month. The meetings commence at 4.30pm in the Council Chambers at the Shire Offices in Forrest Road Capel, and are open to members of the public.
