1 Service Level Agreement From 1 st April 2015 to 31 st March 2016 Specification 1.1 Introduction This agreement relates to the provision of additional educational psychology services, over and above the service that is allocated to the school by the local authority. The standard terms and conditions of the council will apply. The agreement provides for the school or organisation to purchase additional time (in half days (3 hour sessions) or days (6 hours). The amount of time purchased is agreed between the head teacher/ organisational leader or other representative, nominated by the head teacher/organisational leader, and the principal educational psychologist. The use of this additional time will be at the request of the school or organisation (head teacher/organisational leader or other representative nominated by the head teacher/organisational leader) to the named educational psychologist. The time can be used for the usual range of educational psychology duties that typically include: assessment, consultation, intervention, training and development work. This work can take place with individuals, groups or at a whole school level and can involve pupils, staff, and parents and other professionals. This list is not exhaustive and can be amended if both parties agree. The hours purchased will include all the work undertaken by the educational psychologist in relation to the task, including administrative duties. The time needed and the parameters of each piece of work will be agreed between the educational psychologist and the school or organisational representative before the work begins. If there is further involvement needed following the completion of the initial task this will require a new agreement. The time given to schools by the local authority is to enable the local authority to carry out its statutory duties. The additional hours will be provided by an educational psychologist or educational psychologist in doctoral training. All qualified educational psychologists will be registered with the Health and Care Professions Council. 1.2 Length of Agreement This agreement will start on 1 st April 2015 and end on 31 st March 2016 inclusive. 2 1.3 Where the service will be delivered The delivery of the service will take place at any agreed reasonable venue. Assessment and consultations will usually be carried out in schools and occasionally at the child s home. Administrative duties will usually be carried out at the educational psychology service base. The educational psychologist will follow the purchasing organisation s policy and procedures whilst on site and the service s policy and procedures at other times. 1.4 Methods of Charging Maintained schools will be charged via journal transfer on a monthly basis. Other institutions will receive a monthly invoice. When multiple sessions are commissioned these will be spread across the year. 1.5 Cost of the service Description Price 1 day (6 hours) 480 per day Half day / session (3 hours) 240 per half day Training can be delivered by the educational psychologist and will be costed using the rates above. Training can be tailored to the organisation s specific needs. The time and cost of any training, including time for preparation, should be negotiated and agreed in advance. 1.6 Statutory Requirements Both parties will comply with all statutory requirements relating to the provision of the service. Any statutory work arising from this work or any other within the school will need to be prioritised for educational psychology involvement and be delivered from within the time allocated to the school by the local authority or from the additional time provided by the school. 3 1.7 Assignments and Subcontracting The service provider shall not transfer or assign this agreement and shall not subcontract the provision of the service without the prior permission of the purchaser, such permission to be not unreasonably withheld. 1.8 Arbitration A dispute, that parties cannot resolve, will be referred to the strategic director, Young People and Families Directorate. Any decision shall be accepted as final to both parties. We would expect to follow the local authority s complaints procedure. 1.9 Notice If the circumstances arise whereby the educational psychologist is unable to deliver the service at the time agreed with the school or organisation, for example because of absence, the service commits to rearrange delivery of the service within 28 days. If the service is unable to do the purchaser will be informed in writing by the principal educational psychologist within the 28 day period and will not be charged. If the service is unable to deliver there will be no liability against the service for any costs caused by cancellation. If the purchaser decides to terminate the contract the service would need 3 months notice in writing to the principal educational psychologist. The same notice period would apply if the educational psychology service needed to cease the agreement Code of Practice Any service delivered under this agreement will be delivered in line with Sefton Council s policies and procedures and within the principles of Sefton s Educational Psychology Service and professional code of ethics Health and Safety The service provider shall at all times comply with: - all relevant health and safety legislation, and health and safety regulations approved by the Health and Safety Executive Sefton Educational Psychology Service Traded Services Brochure 3

4 - service health and safety policies and procedures - policies and procedures of the purchaser Health and Safety responsibilities extend to staff that undertake work on school premises. Schools are therefore asked to ensure the well being of all staff Disclosure The service provider will ensure that all visiting officers have a fully enhanced DBS certificate in line with the Home Office framework. All enhanced DBS certificates to be subject to review at three-year intervals Equal Opportunities The service provider will comply with the race relations and equal opportunities legislation and not discriminate against any person or organisation on the grounds of race, gender, disability, sexual orientation, age, religion or belief, unemployment / employment or economic status.
